Limits on Spamming

With the Internet fast approaching gridlock, due to the massive influx of folks, Spamming looks more lucrative to the Spammers and yet is less tolerable to the rest of us. A big increase in Spam, supported by myopic jurists, could well grind traffic on the net to a halt. It seems to me that internet service providers, when armed with a well argued and presented case based on police power considerations, ought to prevail in the courtroom. Until we educate the judiciary about the technical problems with keeping the internet open, they'll just do their Pavlovian First Amendment thing, and the Internet may go the way of the buffalo.
